Our litigation experience includes handling cases involving land use issues, disputes over real estate contracts, and construction defects claims, both residential and commercial. Not long ago, we successfully resolved a federal lawsuit and parallel arbitration involving a large general contractor and an architecture and engineering firm responsible for the design and construction of several projects for a federal agency. We have also been involved in a series of disputes involving homes suffering the effects of expansive soils, and assisted an architectural control committee in defending against a lawsuit filed by a developer. Our experience in this area extends to inverse condemnation and other real estate related claims filed against local governments.
We also assist our construction industry clients, several of which have operations outside Colorado, with employment and employee benefits issues on a regular basis.
With respect to real estate transactions, we frequently negotiate commercial leases for shopping center and medical office building space. We also have experience drafting purchase and sale agreements for commercial property, as well as construction contracts for architects, general contractors, subcontractors, owner’s representatives, and owners.
